Frequently Asked Questions

What are my rights if I am arrested?

You have a number of important rights when you are arrested. The Police have to tell you about these rights when they arrest you (discussed below). First of all, you have the right to remain silent, and not answer any questions the Police ask you. You also have the right to talk to a lawyer. You can talk to a lawyer of your own choice, or you can ask the Police and they will provide you with the names and phone numbers of independent lawyers who you can call. The Police must provide you with a telephone and you have the right to make this call in private. If you cannot afford a lawyer, the Police must provide you with a list of legal aid lawyers, who can give you free and independent legal advice. If your lawyer comes to the Police station you have the right to speak to them in private, and have that lawyer with you if you choose to make a statement to the Police.
